MHA commented on changes to the HIPAA Privacy Rule proposed by the U.S. Department of Health and Human Services, Office for Civil Rights. While the changes are intended to afford patients, their representatives, health care providers and social service agencies greater ease in accessing information for care coordination, MHA is concerned that the rule has unintended consequences. Loosening restrictions on the release of protected health information without expressed patient consent or verification of the patient’s identity could lead to fraud and identity theft. MHA also objected to reduced response times for responding to record requests and restrictions on the fees that may be charged. Finally, MHA joined the American Hospital Association in urging OCR to ensure the changes are coordinated with similar requirements imposed by the interoperability and information blocking rules.
