CMS issued revised survey guidance related to COVID-19 vaccination that goes into effect immediately. The guidance directs state agencies and AOs to perform compliance reviews of the staff vaccination requirement during initial and recertification surveys, and in response to specific complaint allegations that allege noncompliance with the staff vaccination requirement. SAs and AOs no longer are expected to perform these reviews on every survey.

CMS previously finalized regulations that reduced Medicare OPPS payments at certain hospitals for drugs purchased under the 340B discount program. Beginning Jan. 1, 2018, CMS reduced the payments from average sales price plus 6% to ASP minus 22.5%. Today, the U.S. Supreme Court unanimously ruled that HHS did not have the authority to implement these reductions. The Court concluded that “absent a survey of hospitals’ acquisition costs, HHS may not vary the reimbursement rates for 340B hospitals. HHS’ 2018 and 2019 reimbursement rates for 340B hospitals were therefore contrary to the statute and unlawful.”

COVID-19 vaccine EUA applications for the use of Moderna in children ages six months through 17 years, and Pfizer in children ages six months through four years, are being reviewed this week by FDA and CDC advisory committees. Yesterday, the FDA recommended EUA approval for the use of Moderna in adolescents ages six through 17.
The new vaccines will be available on the DHSS vaccine order request form beginning today at 5:01 p.m. Orders for delivery the week of Monday, June 27, must be placed by 5 p.m. Wednesday, June 22. Hospitals should wait for final approval by the CDC, and if appropriate, standing orders from DHSS to begin use in this age group.

The CDC issued a health update on case-finding guidance for the current monkeypox outbreak. The update alerts clinicians to clinical presentations of monkeypox seen so far in the U.S. and provides updated and expanded case definitions to encourage testing for monkeypox among persons presenting for care with relevant history, signs and symptoms. Additionally, the CDC recommends that rashes initially considered characteristic of more common infections (e.g., varicella-zoster, herpes, syphilis) should be carefully evaluated for concurrent characteristic monkeypox rash and considered for testing in people with epidemiologic risk factors.

CMS randomly selected the sample of hospitals for data validation of measures within the Hospital IQR Program and the HAC Reduction Program for the FY 2025 payment determination/program year. The list of hospitals and validation resources are available on QualityNet. Selected hospitals will receive a direct email from the CMS Value, Incentives and Quality Reporting Validation Support Contractor.
