CMS Ties COVID-19 Data Reporting To Medicare ComplianceStaff Contact: Daniel Landon or Sarah Willson A new Centers for Medicare & Medicaid Services regulation makes hospital compliance with evolving federal COVID-19 data submission requirements a Medicare Condition of Participation. The change took effect upon its publication in the Federal Register on Sept. 2. After the new rule was unveiled last week, MHA urged the Missouri congressional delegation to ask CMS to withdraw its new interim final rule and engage in a meaningful regulatory public comment process. Although the regulation already is in effect, CMS is accepting public comments until 4 p.m. CDT Wednesday, Nov. 2. MHA developed a resource to assist members with data submission and added a late-breaking session, “Achieving COVID-19 Data Compliance,” on Wednesday, Sept. 9, to the Lessons Learned Webinar Series. The session will address the published rule and provide technical assistance to achieve full compliance.

The guidance follows the recent release of the Centers for Medicare & Medicaid Services Interim Final Rule and guidance specifying new reporting, testing and compliance requirements related to COVID-19. The department outlined new testing requirements for nursing homes, including testing of symptomatic residents and staff, testing in response to an outbreak, and routine testing of staff. A revised, focused infection control survey protocol also was released based on the new requirements. Routine testing frequency for staff is based on the county-level positivity rates, which will be updated weekly. In addition, guidance on reopening also has been updated based on these new recommendations.
