Advance Directives: Ensuring Compliance With CMS and TJC

Overview

Advanced care planning involves making decisions about the care a patient may seek to
receive if they become unable to speak for themselves. The Centers for Medicare & Medicaid Services and The Joint Commission have requirements on advance directives to remain in compliance with the respective regulations and standards. The Patient Self Determination Act, a federal law, addresses advance directives with which all hospitals must comply. It has been proven that better end-of-life care can reduce readmissions. This virtual event will discuss the CMS hospital Conditions of Participation and TJC standards on advance directives to help hospitals ensure compliance.

Objectives

    • describe the CMS Conditions of Participation and TJC requirements for advance directives for hospitals
    • discuss that CMS will now pay physicians to do advance care planning
    • explain what is required of hospitals under the federal law called the Patient Self Determination Act
    • recall that information on the hospital’s advance directive policies must be given to inpatients, ED, observation, and same-day surgery patients under the CMS CoP hospital manual.

Susan Seeley, RN, MSN, NEA-BC

Susan Seeley has over 40 years of experience in the health care industry, both as a nurse leader and as a clinical consultant with a focus on patient care services and regulatory compliance. She is experienced in conducting mock surveys and improving client hospitals’ accreditation survey preparedness through on-site education. Susan has helped organizations achieve continuous survey readiness and assists organizations with writing and implementing successful Plans of Corrections for survey deficiencies. She has also assessed quality programs, clinical operations, the structure and function of medical staff committees, and the implementation of peer review quality plans. Prior to becoming a consultant, Susan spent 19 years as the chief nursing officer for a rural Florida hospital while working part-time for the parent company as a clinical consultant for more than 200 hospitals. She earned her Master of Science in Nursing Administration and her Bachelor of Science in Nursing from Barry University in Miami Shores, Florida. She is a registered nurse and holds an Advanced Nurse Administrator certification through the American Nurses Association.
