Every hospital that has an emergency department and accepts Medicare or Medicaid reimbursement must follow the federal law and the Centers for Medicare & Medicaid Services interpretive guidelines on Emergency Medical Treatment and Labor Act. This includes critical access hospitals.
During PART III of this series, the speaker will explain how EMTALA is involved in various hospital processes, including the medical screening process, certification of false labor, telemetry and hospital diversion, as well as who can be a Quality Metrics Partner. Discussions also will include requests for medication, blood alcohol tests, emergency medical conditions, OB and behavioral health patients, and the Quality Improvement Organizations’s role with EMTALA.
At the conclusion of this session, participants will be able to:
- discuss when a hospital must complete a certification of false labor
- explain state plans and EMTALA
- discuss requests for medication
- describe the Quality Improvement Organization role with EMTALA

Sue Dill Calloway has been a nurse attorney and consultant for more than 30 years. Currently, she is president of Patient Safety and Healthcare Education and Consulting and was previously the chief learning officer for the Emergency Medicine Patient Safety Foundation. She has conducted many educational programs for nurses, physicians and other health care providers. Dill Calloway has authored more than 100 books and numerous articles. She is a frequent speaker and is well known across the country in the area of health care law, risk management and patient safety.
