CMS Finalizes Rule To Penalize Drug Manufacturers

Staff Contact: Andrew Wheeler or Jim Mikes

The Centers for Medicare & Medicaid Services finalized a rule that will penalize drug manufacturers for overcharging 340B providers effective Jan. 1, 2019. CMS previously finalized the rule to be effective July 1, 2019. Enforcement will be difficult because manufacturers would have to “knowingly and intentionally” overcharge providers. The rule also outlines how ceiling prices in the 340B program are calculated.

Missouri’s Medicaid Match Rate Increases For Fiscal Year 2020

Staff Contact: Brian Kinkade

The U.S. Department of Health & Human Services published state Medicaid matching rates for federal fiscal year 2020. Missouri’s match rate will increase from 65.40 percent to 65.65 percent on Oct. 1, 2019. MHA estimates the increase in federal matching funds will result in state general revenue savings of about $15 million for SFY 2020. States’ Medicaid match rates are a function of each state’s per capita income relative to all other states. States with relatively stronger economies will have lower match rates. Therefore, an increase in Missouri’s match rate means Missouri’s economy is not keeping pace with economic growth in other states.
