Missouri Times Corrects CON Article Error

Staff Contact: Daniel Landon

Yesterday’s edition of MHA Today referred to a Missouri Times article on a proposed certificate of need policy change to create an occupancy rate standard for approval of additional hospital beds. Further investigation revealed that the proposed change concerns long-term care beds, not hospital beds. The Missouri Times has corrected the error.

IRS Revokes Hospital’s Tax Exempt Status

Staff Contact: Jane Drummond

The IRS has revoked an unidentified hospital’s tax exempt status for failing to make its community health needs assessment widely available on its website, and failing to adopt and implement an implementation strategy from the CHNA. The hospital had dual status as a 501(c)(3) and governmental entity, and was therefore required to comply with the requirements of §1.501(r)-3. The hospital contended that it did not need its exemption and did not have the will or financial resources to comply with the CHNA requirements. Thus, the IRS deemed the violations egregious and willful. Hospitals should be aware that the IRS has been, and will continue, auditing compliance with the Section 501(r) requirements. Many audits include reviewing a hospital’s website to evaluate whether its CHNA and financial assistance policy are readily available to the general public. This case demonstrates that the agency will take action for noncompliance.
